Buying or Selling a Home/sewer hookups

Question
We bought our first house in Aug 08 in Louisville Ky. At that time they were doing construction to our road (making wider) also installing sewer pipes. After I had already signed the closing papers and moved in, I had a neighbor come over a couples weeks later just to ingage in conversation. During that conversation she informed me that MSD a sewer company had infact put a lein on her property so she could not sell unless she installed the sewer to hookup to her house. My question is is a realtor allowed to get out of paying sewers considering he owned the home before us. And if this is something wrong he did who could I contact?

Answer
Hi Brandon;
If there was a notice that went out about the required sewer hookup before you bought the home then the seller had to advise you of that (as a material fact.) However, since you knew that there was a sewer going in it was part of your responsibility to find out what that meant and what would happen.  I assume that you had an attorney close the property.  You can contact their office for clarification.  you needed to be informed of any pending assessments and if there were pending assessments there should have been something in the contract stating what they were.  Have you reviewed the Seller Disclosure Statement?  Was there anything in there about the sewer lines?  I suggest that you call the closing attorney immediately.

Best of luck.

Experience

Anyone who is in this business and who dedicates oneself to professionalism has continued to take classes and along with it,additional credentials, awards and honors. I can list a host of them, but my greatest accomplishments happen to be those of getting first time buyers (who didn't think they could afford to buy a home)into a home of their dreams. The look on their faces when I hand over the keys is worth all of the hard work.
