Buying or Selling a Home/capital gains tax break

I own a home in new york for 35 years and purchased a home in florida where I am now a  resident.  When I sell my home in New York will  I be entitled to the $250,000 capital gains tax break even though I live in florida most of the year?

Hello Paul - To take advantage of the Capital Gains Tax exclusion on the sale of your primary residence you must have lived in the property for at least 2 of the preceeding 5 years. The time that you live in the home annually may affect the definition, however the rule takes into consideration that people have second homes in which they reside a portion of each year. This answer is to whet your appetite for investigating further with a CPA certified public accountant specifically. Many people who have their taxes prepared for them use a bookkeeper not a CPA. There are only these two types. CPA's attend annual hours of continuing education to be best prepared to answer questions like yours. They are well worth the cost of their services, which usually are not that much more than what 'bookkeepers' charge the unsuspecting consumer. Ask about the advantages of tax code 1031 should you be unable to take advantage of the capital gains tax exclusion or if you hold investment property.
