Buying or Selling a Home/Fannie Mae

Question
Hello, I am trying to purchase a fannie mae home.  Per our appraiser it needs to be termite tented and replace a missing water heater.  Our fannie mae rep told us they would not cover these items.  We negotiated a lower price and we would do these things.  Then when when our loan processor sent over the paperwork we were informed it must be a homepath loan.  Within 15 minutes our broker had approved us and faxed all the info to fannie mae.  Now they are saying the we must guarantee the work be completed before funding yet they will not authorize us to do the work until we take ownership.  Our broker is actually considering that they are stalling to break our contact.  Any ideas on where to go?  We don't want to lose this house when we can show we have done everything fannie mae has asked of us.  Thank you for any direction you may have.   Sincerely Kristy

Hello Kristy - In Arizona the Pest Control Company agrees to be paid as a condition of closing, which means that they perform the work prior to closing and send the escrow company the invoice for the service performed. When the property closed the company is payed by the escrow company through the seller proceeds or the funds brought to closing by the buyer. The work must be authorized by the seller however anyone can agree to pay for repairs. I would recommend you request your lender make a written statement from underwriting indicating that this is the only prior to funding stipulation and once the treatment is complete the funding will take place. There may of course be other prior to funding stipulations that must be satisfied however you will not want to authorize work to be done until you are certain without a doubt all the stipulations can be met.
