Buying or Selling a Home/Quit Claim Deed

Question
Hello, I live in Montana. I am buying my first house. At closing we were informed that there were recorded judgements against a prior owner. I got them from the title company in a copy of commitment. Basically the owner bought this home 11 yrs ago. He rented it to many people, in 2009 he entered into a land contract with a tenant. The tenant defaulted after 14 months. This tenant had prior judgements of over $50K and the title company was concerned. The owner was not aware of these. These judgements are against the individual and not the property. I was unable to run the title through. Last week the owners attorney filed a "quit claim deed" with the county. So if the tenant released all his interest in the home and the judgements are against him am I safe to proceed with the purchase or am I liable for it as the new owner? Thank you for you time.

My suggestion, I would invest in a title exam with a very good real estate attorney before you do anything. The title issues are a concern, if the property is listed for sale, most listing agreements state title to pass fee simple free of defects. With all the has happened, I would be very careful, and listen to a good lawyer representing YOU.
