Buying or Selling a Home/MY DAUGHTER’S BOYFRIEND HAS STOLLEN HER/MY HOUSE

Question
With in the past few months I transferred ownership of my house into my daughter’s name so that she & my 3 grandchildren could have a home.  It was verbally agreed that I (live in my RV) & my 2 horses could remain on the property.  Since then my daughter’s boyfriend has manipulated my daughter’s name off the deed & is trying to get rid of me.  My daughter was unaware that she had signed the title away & now wants to know how we can get it back into her name & my name.  My question is, can this be done? How? & Who do we go to?   We live in California.

Thank you

Answer
The only thing you can do, Teri, at this time is to talk to a good local real estate attorney. This matter has to be taken before a judge. That good attorney will also make sure that the boyfriend pays for what he has done. I recommend you take care of this matter immediately, because you don't know what he is going to do with that property, including selling it. The longer you take, the more this matter will cost.

You could also take this matter to the local district attorney or the state attorney general. But they would probably suggest hiring a good real estate attorney.

Once you get it back, I recommend you put the title of the property into a family trust. That way, your daughter AND YOU will have control over the property. The attorney will explain. I wish you well.
