Buying or Selling a Home/Bad Tenant

QuestionHello Pamela,
My tenant just moved out of my property on 10/15; however, she didn't pay the rent for September and October. I've tried to contact her several times and have left several messages. She did leave a security deposit when she moved in; however, according to our lease agreement, the security deposit is not intended for unpaid rent. So far, she has accumulated around $500 in late fees for August, September and October. She stole an armoire I left in the house which was not paid for. They broke a window, garage door, the screens on the patio, broken door frame and many other small repairs which have started to add up. The worst thing about it is that she is a realtor. I am tempted to call her broker, but I don't know if I can do that. On the lease agreement, the company she works for is listed. What should I do? Should I try to take her to court? I've heard I can report her to the credit bureau and put a lien against her. I just want to re-coupe some of my costs. It's been hard paying for 2 mortgages, especially now that I just had another baby. Your advise is greatly appreciated.

However, PLEASE change that lease. Deposit must cover rent!
Ok your rights. And this all depends on where you live.
1- File a law suit. Get a real estate attorney.
2- Report her to the credit bureau. This will also help the next landlord who runs a credit check. It will also hurt her so she can not buy or make it hard.
3- You can call her broker, but I see nothing there.
You may want to turn her into your local Association of REALTORS. She has to follow all kinds of things and she has broke many.
