Buying or Selling a Home/Contract

Question
My wife and I have seperated and I need to know if I can list our house with a realtor without her signature and if I do would that be a binding contract that she would have to abide by. Her name is on the mortgage.

Hi Charles....
The most important issue in this transaction will be the way the home is titled.  I cannot give legal advice, but if the title says "OR" you may act independently....I would list it. and assume she would have to sign a release, just to be safe....escrow would be able to answer questions pertaining to your state. Just have title info ready, and go for it.....good luck..."~ M
