Question
Is there a statue of limitations[time limit]on suing for failure to disclose a plumbing problem? I recently discovered my seware pipe had been patched[bondoed]& the seller specified to me that this pipe did NOT need replacement.I did not have a professional inspection, but did ask the seller about the same pipe because there was water ruts under the pipe.He stated to my face that these were water runoff from the face of the house. It will be 2 years in Jan.08 of purchase. This house is in Natchez, MS.

Answer
The only statute that would apply from what I can see is fraud, Chuck. Fraud does not have a time limit. However, you did have the opportunity to have a professional inspection. But you chose to not do it. That would make it difficult for you in court. I would suggest you consult with a REAL ESTATE attorney and see what he/she can do for you. I do wish you well.

Expertise

With more than 41 years as a real estate broker, I can solve most any problem presented. If I can`t, I do my research. Problems with mortgages, trust deeds, foreclosures, odd ways of conveying titles. Most any good Realtor can answer questions satisfactorily, but I answer questions that most cannot. Also, ask about my hard-copy newsletter, The Landed Gentry. It can also be sent to you via PDF.
