Buying or Selling a Home/EXCLUSIVE RIGHT TO SELL

Question
MY WIFE AND I DECIDED TO GET DIVORCED AND PART OF OUR ARRANGMENT WAS THAT SHE WOULD SELL OUR HOME FOR NO FEE.  AFTER THE DIVORCE SHE SIGNED AN EXCLUSIVE RIGHT TO SELL BETWEEN HERSELF AND HER BROKER ASSIGNING A COMMISSION TO HIM FOR THE SALE OF OUR HOME WITHOUT CONSULTING ME.  IS THIS A VALID AGREEMENT, DO YOU KNOW WHERE I CAN VERIFY THE RULES SURROUNDING THIS UNDER THE STATE OF MINNESOTA RULES.

THANK YOU!

Answer
In any state, Brian, a listing agreement is not valid without ALL OWNERS signing it. If your name is still on title, then she needs your signature to verify what she has done. If she is a licensed real estate person, then she has to reimburse you for your half of any commissions paid. I recommend you consult your divorce attorney. I do wish you well.

Expertise

With more than 41 years as a real estate broker, I can solve most any problem presented. If I can`t, I do my research. Problems with mortgages, trust deeds, foreclosures, odd ways of conveying titles. Most any good Realtor can answer questions satisfactorily, but I answer questions that most cannot. Also, ask about my hard-copy newsletter, The Landed Gentry. It can also be sent to you via PDF.
