Buying or Selling a Home/Firing your realtor (buyer)
Expert: Dick Dennis - 7/25/2006
Questionwell, thanks for that, i was in anycase going to hire an attorney but up and until reaching that part i am just frustrated with this guy - last nite his wife called and said she cud be the realtor instead (i guess ensuring that they get the $$) -
so in essence whatever i do he will get the money? even if i go directly to the listing agent or someone else? bummer!!
is there like a commission etc where in i can put some feedback/complain so that ppl realize when they talk to him next or something....
ppl like him should not be doing what he is.. IMO

Hi, I am in the process of buying an apt and saw this really nice apt (thru a realtor) but now i am fed up with him. He is extremely pushy on all fronts, has wrongly advised me on a couple of things and just doesnt see my point, always trying to rush me in and pressurizing me to make his $$$. can i fire him and still make a bid on the house (thru the listing agent or some other agent).. what are some of my option? i like the place but cant deal with him
all was well until we decided to put a bid on this apt. firstly when i told him the bod price (6% below asking) - he thought i was way off, nevertheless when they came down 15k, he mentioned that i shld move up the same amount, when i stuck to my nos he said" that i was crazy and that i was wasting his time too since i wasnt going up"
when the seller came down further to my price he was shocked.
Now he is trying to make me sign things that i said i wont till my attorney sees it etc... everyday there are issues.... i have tried explaining it to him and also to his wife (who is a realtor) but to no avaial.. what are my options.. i want the house but dont want to work with him!

You still may be liable to your agent for his fee, whether you buy it through him or not. However, since the seller is paying the fee anyway, I recommend you hire a REAL ESTATE attorney to handle the purchase for you.
The agent was the one who showed the property, therefore he was the procuring cause and has earned his fee. But if you want it to go the way you want, you should have the attorney do it for you. Yes, you will have to pay the attorney's fee, The attorney fee will be the only fee that will be extra for you because the seller's fee is going to be split between his listing agent and the buyer's agent.
Or, if you want to insist on doing things your way, you may lose the whole thing. If the agent will not go along with your wishes, then you may go to his office manager and have him complete it for you. He will ask you what is the problem and you will tell him. If the office manager does not take care of things for you, THEN you can get the attorney.
I do wish you well.

AnswerYou might want to go to the local Board of Realtors and ask to speak to the person who takes care of complaints by consumers. If he has really been bad, you might even bring your complaint to the State Dept. of Real Estate.
Take care.
