Buying or Selling a Home/Lender won't give me information to avoid foreclosure

Question
I am in the process of a messy divorce. My soon to be exhusband did not make house payments and the house is in danger of being foreclosed on. I have made payments and have tried to make arrangements to cure the default. Since my ex-husband is listed first on the loan, the mortgage company refuses to give me any information concerning the loan. My ex-husband still receives all information concerning the house and the loan and will not share any with me. I am hesitant to continue making payments without information or assurances that once the default is cured everything will be okay. My exhusband has said he's going to sign a Quit Claim but hasn't yet and I'm not even sure if this is to my benefit. My ex-husband also has the attitude that if he can't have the house no one can. Please help. thank-you

Based on what you said, Sharie, you have only one choice and that is present your dilemma to your divorce attorney. He will force the lender to give you the information you desire, or, he may suggest you do nothing. Maybe he can get your husband to do the Quit Claim. Then the lender MUST give you any and all information you need.

If you are not on the loan maybe that's why the lender will not give you any information. By law they do not give out information to anyone who is not on the loan.
