Question
Hello, I have a friend that is a same sex relationship (in Fl).  She wants the relationship to be over, they owe on a house, car, and a personal loan together. The girlfriend refuses to settle anything, using this to control her to stay.  We have heard that she can take her to court, the judge will make her put the house on the market, but how do you MAKE her sell?  Due to the situation, she needs to do this in a quick smooth swoop.  Do you have any suggestions?

Answer
That's what filing a "partition" lawsuit is all about, Jessica. Your attorney knows all about it. He will take the matter with all the properties (real and personal) in front of the judge and the court will demand that the properties be sold. Talk to your attorney right away. Make sure it is at least a real estate attorney.

As for the loan together, your friend can pay the loan off and then sue her for her half after making demand. Your attorney knows about that, too.

I do wish you well.

With more than 41 years as a real estate broker, I can solve most any problem presented. If I can`t, I do my research. Problems with mortgages, trust deeds, foreclosures, odd ways of conveying titles. Most any good Realtor can answer questions satisfactorily, but I answer questions that most cannot.
