Buying or Selling a Home/Purchased new home and owner will not vacate

Hello,

We live in MA. and purchased a home 5 months ago.  At closing the owner informed us that his new home was not finished and asked if he could stay in the home we just purchased for 3 months while his home was completed.  We verbally agreed and stayed in our old home during this period.  It has now been 5 months and after numerous excuses and delays he is still living in our home.  Furthermore, we just learned that he has now just begun construction of his new home.  We have asked on numerous occasions to move out but now refuses.  Their are no written agreements or leases and he has not paid rent (nor have we asked) for his stay in our home.  We just want him out.

Any advise would be greatly appreciated.

Remember this if nothing else, Mike:

In real estate, if it is not in writing, it was never said!

Now you have a legal problem. You immediately go get yourself a local REAL ESTATE attorney and get that bum out of there. And make sure the attorney helps to make sure the former owner does not take the house apart before he leaves.

It happens every time.
