Question
Myself and a partner jointly own a beach house in SC.  We are no longer friends and he has decided to sell his half of the house.  Our mortgage is 50-50.  
- can he do this without my permission?
- if I don't concur with the sale how can he get a clear title to his share?

Dear Wayne,
You and your friend must both sign off on the house in order to sell it.  Without your signature, there can be no clear title delivered at closing.  This is similar to a situation when a couple is separated and the wife wants to sell and the husband doesn't (or visa versa).  We,as brokers must obtain permission from both parties since they are joint owners.

If your partner wants to sell, then there might be something you can work out through an attorney.  It will require you to buy out his share or finding another person to invest in the property and buy your ex-partner's share then transferring title appropriately.
