Buying or Selling a Home/Selling
Expert: Sue Bernstein - 7/6/2006
QuestionI am trying to sell my home in Ca. and buy in Ok. I found a home in Ok. that I made an offer on. The person selling wanted my realtor's name and number so she could determine that, indeed, my home was on the market. When she contacted my realtor he informed her that my home was on the market, however that it was over priced. My realtor is the one who set the selling price in the beginning. He also has lowered the asking price $18,000 in a two month period. I signed an exclusivity contract with him, but he has broken my trust and am wondering if there are legal means of voiding that contract, and if there is an agency I can report his conduct with.
AnswerDear Douglas,
I don't blame you for being upset with your agent. I would confront him and ask him to explain why he would undermine your purchase in OK by stating that you were overpriced when you had it listed based on his recommendation. If he cannot justify his behaviour to your satisfaction you can ask him to cancel the listing. He does not have to agree. If you feel that he has not acted in your best interest and has not been honest in his dealings with you, you can complain to his manager and ask that they give you another agent and you can file a complaint with the Department of Real Estate and with the local Board of Realtors.
I hope this helps and good luck.
