Hi...I found someone to sell me a garage parking spot in the condo building that I currently reside in.  I was wondering if you knew what was involved in transfering this piece of property from the owner to myself.  would this be like a regular real estate transaction?

Hi Mike,

Regarding the purchase of a garage parking spot in your condo building, so long as …

1.   The garage parking spot is deeded to the person willing to sell to you, as opposed to being a part of any COMMON area, and

2.   There are no restrictions prohibiting such a sale as covered in the

A.    Deed
B.    Condo ByLaws, and or
C.    Covenants and Restrictions

… then I would think it could be handled as any other real estate transaction.

Before you pay anyone for the spot, you might want to check with the homeowners’ association and/or an attorney.  What you don’t want to do is pay for the spot, have a problem, have to rescind the purchase and then fight the previous owner to get your money back.
