Buying or Selling a Home/contigent contract

Question
We signed a contingent contract to buy someone's home, contingent on us selling our home. Contract is for 90 days.  I now regret it. If I get a purchase agreement to sell our home, can I simply have the closing date on a date later then 90 days to void our contract to buy?

Answer
Dear Paul;
I cannot ethically tell you to cause a delayed closing to void your contract. Since this would mean that you were manipulating the situation to the detriment of the seller and attempting to keep the seller ignorant of the fact I think that it would be best for you to discuss how to extricate yourself from the contract with an attorney.  Not having seen your particular contract and the wording, there could be ways to do this legally without having to delay the closing on your existing home.  (Personally, I think I would be inclined to tell the seller that you want out of the contract. Since it is contingent on a sale it is not really a sold home anyway and the seller may be eager to let you go.)

Good luck and best wishes.

Experience

Anyone who is in this business and who dedicates oneself to professionalism has continued to take classes and along with it,additional credentials, awards and honors. I can list a host of them, but my greatest accomplishments happen to be those of getting first time buyers (who didn't think they could afford to buy a home)into a home of their dreams. The look on their faces when I hand over the keys is worth all of the hard work.
