Question
My neighbor is selling part of their property the are using a road that goes through our property to access this piece of property they do not have an easement from use to use this road our other neighbor does have one. does the new owner of the property have to purchase an easement from us? and should I place a gate across the road and stop them from using the road they have been using it for some time without our permision the property was my father in law and we just inherited it this January? Do they have to disclose to the new buyers that an easement is required?

Answer
Well that depends upon how long they have used the road with your "implied" permission.  After a certain number of years, it becomes an easement simply because you never complained about it and stopped them from using it.  You might need to check with a title company and/or a real estate attorney to determine if there is anything you can do now. Certainly, you can let them know that they do not have a granted easement and in order to get one they must pay you a certain amount of money.  If they agree and don't come back to you with the answer that they have an implied easement, then you are free to negotiate a deal.
