Question
I am a 40 year old female planning on moving from NY to Florida. My husband and I have been separated for over 7 years. I found a home I like but when applying for a mortgage I was told that in Florida I would need to have my husbands name on the title. We have not even spoken in almost 2 years and I don't trust him as far as I can throw him. Any advice? Are all states like this?

Answer
No, all states are not like this, Ellen. Some are worse, like Georgia where a husband can buy and sell for himself, but the wife cannot. I would say move to California because here you certainly can own property on your own and without your husband's permission. As for Florida, I would suggest you consult with a Florida real estate attorney. Just get on line and ask. There probably would not be a charge. I do wish you well.
