Question I will be buying 5 acres of land from my brother . where would I find a simple form to convey this property with out useing banks or attorneys. The land is described in the previous deed of land purchased by my brother.
Answer You are asking for trouble, Joe, if you do not at least engage a real estate attorney to make sure this transaction goes down right. You'd be surprised how many of these questions I get from people who have to unwind a transaction that was done a few years ago because the parties didn't know the proper documents to use. You would also need title insurance. You have no way of knowing what kind of liens your brother may have on that five acres. He might not even know it. It may have been conveyed to him with encumbrances on it. Maybe a real estate agent might get you the proper document to use. You should use a Warranty Deed to actually convey the title.
With more than 41 years as a real estate broker, I can solve most any problem presented. If I can`t, I do my research. Problems with mortgages, trust deeds, foreclosures, odd ways of conveying titles. Most any good Realtor can answer questions satisfactorily, but I answer questions that most cannot.
