Buying or Selling a Home/offers w/ contingencies

Question
I am in the process of selling my home through FSBO. I have some interested parties, one in particular wants to make an offer, but said she'll have to make it contingent on selling her home. Are there any ways to accept her offer with a contingency of my own? One that would allow me to accept a better offer from another potential buyer and release me from the orginal buyer's contract? Any advice you have is much appreciated!

Thanks in advance!

Answer
HI Matt,

Thank you for your question.

Going into contract with someone who has a house to sell makes you subject to the sale of their house.  You are really not in contract.  So, you could make a contract with them subject to the sale of their house, but if you got a better buyer first you could dump them???

Just don't bother with these contracts and wait fot a ready and able buyer, which could be them if their house is sold.

Hans.

I am able to answer questions related to buying or selling residential real estate in New York. There are many questions buyers and sellers have about the process of buying or selling a home that they are afraid to ask or that might seem too simple to ask. For instance: in a house, why do some doors open in and some doors open out?
