Question
Is it legal to owner finance a home in Texas while there is a lien still on the home.  My mom and stepdad are living in the home and would like to buy it, but may not be approved for a conventional loan.  I take it I would still be ultimately responsible for repayment on the loan if something goes wrong.  Also, what about mortgage assumption?

Dear Bonnie;
Are you saying this is your home and now your parents are living there and want to buy it from you?  If they can't get a loan and are paying rent to you there is always the possibility of assuming your loan.  They should contact the bank that holds the mortgage and suggest taking over the payments which then releases you from any further liability.  Unfortunately, many loans are not assumable.  You will need to find out about it.  If you find that yours isn't assumable you may need to refinance with an assumable mortgage that you mom and step-dad can then assume.  (They will still need to qualify though.  There are restrictions and rules that will need to be followed so a frank discussion with the lender is very important before taking any action.)
