Buying or Selling a Home/purchase agreement

Question
I would like to get out of the purchase of a condo in South Florida, Flamingo South Beach (North Tower). I have signed a purchase agreements which states the closing will be on or about October 2, 2007. It is now November 5, 2007 and we have not closed yet due to no particular reasons can I use this to get out of the purchase agreement.  Thanks

Travis--It's difficult--if not impossible--for any of us here to give you a definitive answer to your question! Why? Well, that's because you've entered into a Purchase Agreement, a form of Contract, and we have no way of knowing all of the specific terms & conditions of your Contract with the Seller! On the face of things, however, it would seem that you have a Contract that has "Self-Destructed" as one party to the Agreement has failed to "follow through!" You should get a LEGAL OPINION on your situation, however,an d I'm NOT an Attorney NOR a licensed Real Estate Agent--so I URGE you to BOTH discuss this with your Realtor AND a Real Estate Attorney. They can help you determine whether or not you can use the failure to close by the Contract's "stated Closing Date" as
a means by which to legally "walk away" from the transaction with either a REFUND or FORFEITURE of your Earnest Money Deposit! Good Luck--JIM
