Buying or Selling a Home/quitclaim deed

Hello,
My question is kind of complicated, recently my boyfriend's brother died unexpectedly without a will. The family home had just been transferred into his name, with joint suvivorship so the home is going back into his mothers name. His mother is in a care center and the state had wanted to take the home to pay her bills. The other two kids and the mother would like the home to go to my boyfriend, who lives there. Is there a way to put the house into his name and mine, or will the state just take it?

Dear Ann;
Ordinarily I would just click on the response that this is a question I cannot answer.  However, I think that you need to be given some direction here.  This is a legal issue and involves wills and title which is something an attorney that specializes in estates must help you with. When the home went back into the mother's name, I am afraid it may have given the authority of ownership to the state and cannot be put in someone else's name at this point.  Check with an attorney to be certain...and act very quickly!
