Question
My husband and I are considering selling our home by owner... what are the NY state laws regarding this, and where can I find these laws?  What is the seller required to have on hand/ perfomr prior to viewing a contract from a potential buyer?  Is there a title/ lawyer team in WNY that has special experience in FSBO?  Thanks!

Thank you for your question.

If you are selling your home on your own you need to be able to deal with buyers and others who will respond to your advertising.  The only person you need to hire is an attorney to handle the closing unless you can write your own contracts.

There are no laws regarding selling your home on your own.  New York is still a buyer beware state.  It would be good to have a survey and your title report on hand.

The National Association of Realtors says that FSBO's get 27% less for their homes than those listed and sold by Realtors.
