Ron,
I have had my house on the market since the end of May with virtually no offers.  I've decided to wait for the market to pick up and rent my house.  My question is this:  What kind of tax break can one get (in California) for renting out a home?

Hi Megan...

I am not sure if you have received an answer to your question, but if you didn't or if you did, you maybe able to use the following information...

If this home was used as your primary home, you have to show to the IRS that you have lived in the home as your primary residence for 2 out of 5 years. This will allow you to take advantage of the IRS tax exemption of $250K if you are single, or up to $500K if you are married. By doing this, you would not have to reinvest in an income property to protect your tax liability, as long as you actually closed escrow prior to the five years.

There are tax benefits towards your Federal & State Income that can be taken every year for up to 3 year period that you rent your home. Every situation is different and since I am a California Realtor in Marin County, and not a tax advisor. You should contact your CPA for a full explanation of the benefits and don’t forget to ask your CPA regarding a new tax exemption on your replacement home once you sell the property in question or your current home now if you bought prior to selling your property. You might be pleasantly surprised at the answer…
