Buying & Selling Thru Ebay & Other Auctions/paid for item not sent

QuestionI paid by cheque for item as not enough funds at time in paypal account.CHEQUE CLEARED IN MY BANK ON 08/01/09.Seller left uncalled for feedback on 10/01 09.Since then have sent numerous emails asking if item has or will be sent -but no reply to date 23/01/09.Have contacted Ebay -have to wait up to 10 days for resolution process.What does this involve-am I likely to get my item or my money back.Thanks.

When you pay with a check or money order there is no guarantee you will receive your money back. It is always best to pay with PayPal.
eBay's dispute resolution process can take a while (up to 10 days). Use these 10 days to communicate with the seller about what has happened and what you want to happen. Make sure you have really told your side of the story in the dispute. That way, if you close the dispute as unsatisfied, eBay will see what you have gone through in your own words. This process can make it very uncomfortable for the seller. If you close the dispute after 10 days "unsatisfied", eBay will investigate this seller, and you most likely will receive your money back.
If this were my transaction, I would make it clear in the eBay dispute process that your check was cashed, the date it cleared the sellers bank & account number (found on the back of your returned check).
Can I ask what kind of feedback the Seller left? I realize a seller can no longer leave negative feedback, but they can leave a negative statement in a positive box. If they did do this, you can email eBay and have this removed. Your seller could possibly be suspended for 7 days for doing this.
Do you know that you can pay with an e-check out of your PayPal account? The money is taken directly from your checking account, and within 2-5 days the seller has your money. Using PayPal in this way will guarantee you receive the item or your money.
I am really sorry this seller has not sent your item to you. I hope this gets worked out and you receive your money or the item.
