Question QUESTION: Hi Tim,
I want to apply for PR and want to gain my spouse's points also..
I got engaged few days back and planning to marry with her after 6 months..
Can I apply for PR under fedrel skilled workers class NOW ?
When I need to show the marriage certificate,Can I show the same later?

ANSWER: Dear Hardip,
If you are qualified to apply in the federal skilled worker category -- or any other category for that matter -- there is nothing to prevent you from applying for immigration now. Once you get married, you would have to add your spouse to the application by completing a set of forms for her, attaching all relevant documents (marriage certificate, birth certificate, passport, photos, police certificate, etc) and pay the additional related processing fees.
Your wife will also have to satisfy existing medical admissibility requirements.
Whatever you do, don't get married after you get the visa and before you arrive in Canada. Many applicants receive their visa, get married, then go to Canada only to learn that they may in fact lose their status because of a failure to declare the marriage and obtain instructions from the Canadian visa office.
You may marry during processing of your case or AFTER you have arrived in Canada, obtained your status as a permanent resident (in which case you would have to sponsor your wife later and she would have to undergo a separate immigration process that could take 8-12 months, possibly more).

QUESTION: Hi Tim..
Sorry to bother you again..I want to apply for pr under skilled category but my total points would be 65 if I show myself as an Individual..
One immigrant consultant told me that I can apply now and first CIC will check my eligibility of the skilled workers class and if I got approved in this category then they will check the points system and other supporting documents...As per him,this entire activity will take approx. 5-6 months atleast and in the meantime I can marry and add my spouse's education points in totallity to get through....
I would request you to please guide me on the same as my problem is that right now I can't marry and without marriage I can't earned required points now..I can only get married after 6 months..Pls assist.

ANSWER: Dear Hardip,
In theory, an applicant can apply now and add a spouse later. However, this principle only applies to persons who are already qualified. If you are not yet qualified, which appears to be the case, there is no point applying now because your application will be refused. Immigration Canada will assess you on the basis of the points you would receive at the time the application was received.

QUESTION: Hi Tim,
Your answer was perfect and it has cleared the doubts completely in my mind...
Tim, In this case,please tell me if I attach the undertaking of French Knowledge(as am learning french also) with the immigration application,Can I get some additional points under education category as later Either I can show the TEF Results or Spouse's Education degree to get the sufficent points for qualify,,,
In short, Is it possible that now I show french knowledge to get additional points and later on i can replace these points with my wife's education points....

Answer You are entitled to points in English and French (or 1st and 2nd official language) but you need TEF and IELTS results to prove it.
