Question
QUESTION: Can you please tell me if a violation of a red light camera infraction in Alberta is Civil or Criminal charge??

thanks, Eileen Theologus

ANSWER: It is a Traffic offense

---------- FOLLOW-UP ----------

QUESTION: I know it is a traffic offence but what law is it or what court for a complaint that the service requirements according to the rules of court were not met?  Do the red light traffic violations when contested go to civil or criminal court and what legal service rules are then in effect?  Example:: If this is a civil matter I need a certain kind of service according to the rules of court.  If it is a criminal matter I need a different kind of service.  The rules of court must be followed as the red light traffic camera is a search of the vehicle and results in possible seizure of money (the fine) will I be applying for default judgement due to improper service according to criminal court rules or civil?

Answer
again I tell you this matt5er would be heard in Traffic court, indirectly a part of Criminal Courts , in no way is this anything to do with Civil court.
As well you should note that as stated in my profile I only deal with Ontario HTA.
You should clarify your question by simply contacting the court listed on your ticket.
