Canadian Law - Radar Speeding Ticket

Expert: Mark C. Robins - 11/29/2008

Question
I am in Alberta and recently received a speeding ticket that resulted in an mandatory court appearance. It was my first experience with what is called "intelligent Cruise Control". If you ask me its a safety hazard. I had a few questions in regards to this situation...
Is it mandatory that the radar result be shown to you for the fine you are receiving at the time of the incident? Do they have to provide a second read out? If I was never shown the radar result, is this reason enough for the ticket to be dismissed? You mentioned in another inquiry about asking for a calibration request. How much time before the court date do they need? How do you go about asking for a calibration request on the instrument that was used to clock your speed?

Answer
You should file your disclosure requests as soon as possible.
Check with the court office to see how many copies of the request you need and where to serve and file, if not seek the advice of a lawyer you can get a free referral at
