Question i was convicted about 5 years ago in Alberta for theft over $5000.000 from the company i worked for, sentenced to: 9 months house arrest, 12 months probation, stay away from drug's and alcohol, pay restitution to my employer for their $2000.00 insurance deductible. i did all these conditions and was released from probation 21 months later, thought it was done with.
a few day's ago though i get a call from a collection agency in Edmonton stating they have a court ordered restitution ordering me to pay the insurance company back the $20,000.00 i stole. i said no, i only had to pay the $2000.00 deductible which i did, he said no and he sent me a copy of the order. it is a completely different restitution order from the same judge but dated 2 months after i was originally sentenced. i was never served with papers or anything, and as i said i knew nothing of this until now, 5 years later.
is there anything i can do?, i live in a different province now, does it still have authority? and it was originally to one insurance company and they have apparently been bought out by another so now i owe them. is this all on the up and up?
Answer I recommend that you consult with a lawyer you can get a referral at www.lawyerlocate.ca
What was it about my answer you objected to?
You are being harassed by a collection agency, if you now live in Ontario the collection act specifies that all collection activity must cease once they are contacted by a lawyer.
I simply suggested that you get advice from a lawyer.
If this does not suit you too bad!
