Question The property I'm living in now with my daughters is a joint property with my husband. The other owner (my lawful husband in this case) and I have no contact with each other in any way in the past four years, neither has he been contributing to the mortgage payments for the property. Unfortunately, the time has come were my daughters and I could no longer afford the monthly mortgage payments and the usual upkeep expenses on the property. Since the fall out with my husband, he has not called and visited us and we had made attempts to contact him in the past years.
Could I have the property listed on my own? If i were to sell the property what legal approaches is necessary for the sale to be legitimate with my signature only?
Answer Hi Gina,
I'm sorry to hear about your situation. Unfortunately, everybody on the title has to sign the listing agreement. You can probably get a way around it since your husband has gone missing for several years now. I'd suggest you to consult with a lawyer in terms of how the transfer of ownership would work.
