Canadian Real Estate/Previouse conditional offer

Question
My offer was accepted on a house with a previously accepted conditional offer. This previously accepted offer contains two conditions.

The first condition is for the sale of the buyers current home which must be lifted within 48 hours of the seller accepting another offer.

The second condition is for a home inspection, which was already done but the condition was never lifted. This condition expires 3 days after the first condition.

The 48 hour deadline from the first condition passed almost 36 hours ago yet I have not received confirmation of the condition being lifted. Can the seller choose to not disclose whether the first condition was lifted or not until the second deadline?

Thank you for your help.

Pierre

Answer
Hello Pierre and thank you for your question.

If your offer is conditional upon removal of all conditions of the previous offer then you would not be notified until the second deadline.

But in my opinion you should be provided with an update. If the condition on the sale of the buyers home was lifted then all they need to do is the home inspection and unless there is something really wrong with the home the previous deal should firm up.

I would ask your Realtor for an update on the status of the previous offer.
