Question
Hello Sir,

I had a quick question. I have been accused of violating article 112a. I have taken a urinalysis. Not many people have the same situation im in so thats why i am asking you. I have not yet been charged with anything yet, but what type of discharge would someone recieve if they were found with steroids? It goes under the Article 112a but it is scheduled as a Schedule 3 under this article. Most discharges for this offense are of marijuana or cocaine. Which are a Schedule 1 offense. My question is for a schedule 3 offense of article 112a what type of discharge would most likely happen? Also would there be a chance of getting it lowered? Thank you

Answer
Nick:

Pretty much the same kind of discharge that you would get for any other illegal drug, if convicted.  If this is a first offense and they decide to discharge you, then an Other than Honorable discharge is the more likely.  If you are court martialed, then a Bad Conduct discharge is possible.

Seek advice from a JAG lawyer ASAP who will explain your rights.

Expertise

Questions relating to US Marine Corps; rank, awards, uniforms, career choices. I can also help people spot and expose fakes (people pretending to be Marines or have awards they didn`t earn). Considering the Marines as a career? Or another branch, like the Air National Guard? Drop me a line. HOWever..know that I am NOT a recruiter. I can offer my expert opinion and advice, but can't (and won't) over rule what a recruiter says, they are the 'on duty' expert.
