Question
I have gotten out of the military about 18 months ago... At the time I was overweight and had a clearance... Currently I am serving PTI (Pre-trail intervention) and a Felony charge... the judge and lawyer have said if I complete the PTI that "This would never have happened!"  My question is as long as I have gotten my weight down and I have successfully completed my PTI would it be possible for me to re-join and possible get my Clarence back or am I just going to be fighting a battle I can not win

Dear Eric --

Since I do not know the details of your offense requiring pre-trial intervention, I cannot predict how your waiver process would go.  Also since I do not know what kind of discharge and re-entry code you received, what I tell you below, may be moot.

If your offense is waiverable, and you make enlistment weight, you can re-enlist.  If your offense is not waiverable, you cannot re-enlist.

If your offense is waiverable for enlistment, it might not be waiverable for a clearance.  In that case, you could re-enlist, but would require a new military occupational specialty.

If your discharge is less than honorable, or your RE Code is 3 or greater, you will have a difficult time gaining waivers for re-enlistment.
