Hello, I was wondering if you thik I have a good case to have my discharge upgraded. I recieved a Ch14-12c from the Army a misconduct discharge for commision of a serious offense, adultry. I am NOT married but I did have a relationship with someone in my unit who was. This idividual recieved a Co grade ART 15. He was higher ranking than me and he is also still in the Army and has had no further punishment. I did have a previous Art 15 for indecent acts but the other individual involved was also punished. In my chapter paperwork they mention 3 adulturious acts. but they can only prove the one. Is there anyway that I may have a case? If you don't have any answers for me is there anyone or anywhere that you know of that may help me out. Thank you very much for your time.

I think that you need to contact an attourney.... You can only committ an adulturious act if you are married....Thats the charge they should have given the guy that was married.

keep in mind that this is going to be a very expensive undertaking,and finding an attourney that will take on the ARMY is another. Somehow I think you got screwed....Its going to be a hard one to prove, but its definitely worth looking into.
