Question
Hi,

My boyfriend is trying to join the military but has an issue. He is most interested in joining the Navy or Coast Guard but has two charges of attempt to distribute which I believe are felony charges. He was never convicted but did do his probation. He was actually allowed to do only four years instead of five. During that time he went to college and received his associates degree. He now owns his own business and has not had any other issues. My neighbor was previously a recruiter for the Navy but is now in a different field. My boyfriend has spoken with him at length and in turn my neighbor spoke to the recruiter that is in the area. The recruiter said it is not possible for my boyfriend to join due to the past charges. Is there any way around this? I read about the possibility of applying for waivers? Please help! Thank you for your time.

Answer
If he did probation for the charges, then he was convicted.  He may not have done jail time, but he would have only had probation if he was convicted.  If it was lowered to possession, then he would have a chance.  The military is not currently allowing anyone with any felony conviction to join and serve.

Sorry for the bad news.  At least he has turned a positive note in his life, and that is a great service to our country as well.

Expertise

I am a National Guard recruiter , been doing it for seven years and am a subject matter expert on qualifications for National Guard and I keep up to date on Regular Army regs and programs. I was in the Navy for 4 years and have 13 years in the Guard. I will not sugar coat my answers to you. They are usually short and to the point. If you need more in depth, ask me. Because each situation is different, alot of times you need to actually talk to a recruiter and let them evaluate your situation in person, by looking at your documents, issues etc. If I suggest this, it would be in your best interest to do so. Finally...thank you for your interest in serving this great nation of ours. Very few people can actually make the cut to serve let alone choose to do so. So thank you for wanting to and hopefully you will get a chance. Whatever branch you choose, thank you and good luck.
