Question
My husband is going to be discharged for failing to select to CDR for the 2nd time. He is SELRES Unrestriceted Line Officer. He has orders for mobilization for Kuwait on 30Dec09, however he is to be discharged no later than 31Dec09. He obviously wants to stay in to serve his country, Title 10 SS 14506 is not as cut and dry as it appears. I am desperately trying to find help resolving this issue. Is he eligible for continuation? His designator is 1105. As a side note there we no other 1105's selected this time around.

I'm sorry to hear that your husband was passed over twice.
If he was eligible for continuation he would've been told so after the results of his last promotion board.  Since he wasn't, that means he has reached his "High Year of Tenure" and must get out.  Therefore he will not deploy to Kuwait.
I know that's not what you wanted to hear, but that's the facts.
I thank him for his service to his country and thank you for your commitment and support.
