Question
Involuntarily separated in Dec 1992, Air Force Capt. Paid ~42K. Subsequently received 10%VA disability in June 1993. But, I've not received because I received the separation money.

Have recently be told to request a waiver from VA on further recoupment of monies.

In 1994 I went into the reserves and retired with 20 good yrs from the AF Reserves in Oct 1999. Scheduled to start receiving retirement pay in Oct 2011 when I turn 60. While in the reserves I received monthly reserve pay and a couple of months active duty pay while serving active duty assignments.

I'd like some assistance or resource for some powerful arguments to support my letter requesting the government stop recovering my 10% disability. I'm down to ~$22,500.00 as of last month!

I'm requested assistance from the American Legion, referred to a case person, have called twice in three weeks, no response from him/her.

Your assistance is greatly appreciated.

Answer
Phil,
Your question was forwarded to me because the expert you selected couldn't answer.

You've done all the right things.  Sounds like your Case Worker is a dud.  Have you talked to the VA direct?   If not, give them a try at at 1-800-827-1000.  Also, if the Am. Legion is no help, try your local chapter of the Disabled American Veterans(DAV), and ask to speak to a Service Officer.  They're very good at this stuff.
Good luck, and thanks for having served.
