My ex and I are not on good terms either but communicate for the babies sake can she refuse to sign anything and if she does refuse will it effect me or what are my ways around it.      p.s. we are not planning on fixing the relationship i just wanna be there for my son and she has excepted that but may hold the waiver over my head if its no benefit to her

Answer
Hi Brandon,

This is covered by the Air Force Recruiting Regulation, AFRSI 36-2001 (http://usmilitary.about.com/od/afreg/p/aetci362002.htm). You may wish to read this regulation, doing a search for the word, "custody," and read all of the paragraphs that come up in the search.

Basically, before you can apply for a waiver, you will have to obtain a court-order that says you do not have any custody of the child (including "shared custody.")
