Question
My son is facing possible charges from two years ago.  He is in the Coast Guard now.  How long will they hold his position and can he still work until this issue is resolved.  Also if and I pray not he is charged with a misdemeanor will he still be able to serve our country

Dear Diana --

Unfortunately, I cannot answer your question.  There are far too many variables in these circumstances.

If the state chooses to arrest him, or he is convicted with prison time, he will be discharged.  

However, he may be able to negotiate with the state, due to his current job and good behavior, and plea bargain an agreement that allows him to continue to serve.  He would never serve prison time and would have no record at the end of this probationary period, as long as he never breaks the law while in the service.

Depending on how understanding his current chain of command is, a situation between these two extremes might allow him to continue to serve. However the details of the misdemeanor, and the required/court ordered penalties will have major effect on the outcome.
