Question
I have a question if you don't mind me asking. I am presently in the process of getting everything ready for the board of naval corrections to review my case to upgrade my discharge, my deli ma is I am out of work and I have wife and daughter to support and my military career was striped from me, with out any just cause, here is my story I joined the navy in 2006 after doing two years in college, went in to do EOD I got sick in boot camp so that didn't pan out and I went to A school for intelligence my recuter lied to me and maid it out like I would be doing counter intel work, which was cool my uncle just recently retired as a CWO4 from the army in that area, I thought id have a good time, unfortunate big lie, the NAVY is computer etc, so I was able to squeeze my way out but had to go to a ship, but do to navy regs i was afforded the opportunity for a new job after 3 months because i came in as an e3. So I went Aviation Ordinance which was cool worked with weapons. 2007 I got married and volunteered for a deployment to GTMO Cuba to be a guard well this is were shit hit the fan I had an allergic reaction to my stab vest and medical said he will not wear a stab vest, my chain of command was pissed because they had to put me in a new job.  Which was supply I did great I noticed things going missing and I was in the lime light of my command noticed a=lot of unethical things going on I went to my PO1 and told him something needed to be done, told me to shut my mouth, at this time I was working on converting jobs because I held a TS Clarence and the navy just created an interrogation unit.  well they notice a discrepancy in my paperwork the navy does periodical evals and one of the evals was altered, funny thing is admin is the only one who has acess they accused me of altering this eval to make rank, even though they tried to say it happened there, than recanted said it happened at my old command, than said i changed it we i transfers, so there was holes all over, even the investigator in here report said they could not prove I did anything, but i had a duty to ensure all paperwork in my request to change jobs was accurate, Here is were it gets nasty so I denied article 15 punishment, went to executive officer hearing and said sir in all do respect why would i give up a ts clearance for some small increase in pay for rank, and why would some one of my intelligence done such a sloppy job, is not possible there is a mistake hear, i told him  how i would have not have gotten caught, well they commander decided to let me go but he wanted to give me an oth my lawyer fought for general, i received gen re4, commision serious offense. whats funny in the commanders letter requesting the admiral to separate me from the navy he brought up my medical issue, and the evidence they used and sent to the admiral was altered to make it look like what i had suggested of how i would have gotten away with it, what they did not count on is I kept documents of everything and.  my complaint against my direct chain of command in regards to misconduct issues and fraud waste and abuse. my question is if I have all these documents and a referral from a major who knew me in GTMO and my uncle a CW5 retired is it possible to possible get a waiver to serve in the Army or Army national guard.  V/R Mr. Chipchase

Answer
Usually RE4 discharges are not upgraded, very few ever are.  If they do upgrade it, you might be eligible for a wiaver, it depends on alot of things, which would include your charegs you had to get the discharge.

If an re4 is upgraded, then take the next step, but wory about one thing at a time right now.

Expertise

I am a National Guard recruiter , been doing it for seven years and am a subject matter expert on qualifications for National Guard and I keep up to date on Regular Army regs and programs. I was in the Navy for 4 years and have 13 years in the Guard. I will not sugar coat my answers to you. They are usually short and to the point. If you need more in depth, ask me. Because each situation is different, alot of times you need to actually talk to a recruiter and let them evaluate your situation in person, by looking at your documents, issues etc. If I suggest this, it would be in your best interest to do so. Finally...thank you for your interest in serving this great nation of ours. Very few people can actually make the cut to serve let alone choose to do so. So thank you for wanting to and hopefully you will get a chance. Whatever branch you choose, thank you and good luck.
