Hello John, my name is Tom and I have a question concerning criminal waivers.  I am interested in joining active duty army, but I have a feeling I might be disqualified since my criminal charges happened after age 18.  In 2003, I was charged with possession of marijuana and paraphernalia. Then in 2005, I was charged with a class C felony for possession of a controlled substance, but that charge never led to a conviction.  I received a suspended imposition of sentence and was given 5 years probation, which I finished a few months ago.  My lawyer, who used to be an Army recruiter, told me I shouldn't have a problem getting excepted since my felony charge does not show up on my record.  But I have my doubts about this.  If I cannot get accepted into active-duty, what about the Missouri Army National Guard?  Do you think they will take me?

Since you were on probation for the crime, though not a criminal conviction, the military still views it as a conviction since you were "punished"  That is what would make you not eligible.  The charge and the deferrment(probation) does show up on criminal checks.

Sorry, no military branch can take you.

I am a National Guard recruiter , been doing it for seven years and am a subject matter expert on qualifications for National Guard and I keep up to date on Regular Army regs and programs. I was in the Navy for 4 years and have 13 years in the Guard. I will not sugar coat my answers to you. They are usually short and to the point. If you need more in depth, ask me. Because each situation is different, alot of times you need to actually talk to a recruiter and let them evaluate your situation in person, by looking at your documents, issues etc. If I suggest this, it would be in your best interest to do so.
