Jason,

My question is regarding reenlistment.  During my enlistment in the Marine Corps., some Marines in my Battery that I hung out with ended-up getting in serious trouble.  Three of them had failed a battalion drug test and were sent to CID for questioning.  While at CID, they had mentioned my name, along with two of my friends, as being involved (I guess as some kind of bargaining chip).  Neither of us had failed the drug test, although the Marines in trouble stated that we may have participated in the unlawful behavior.

To make a long story short, we were basically given the option of accepting NJP and possible separation, or requesting courts martial.  I was advised to accept NJP, which I did, and was separated with an OTH and RE-4 reenlistment code.  My other friends whom also had nothing to do with the incident decided to go to trial.  They all received maximum penalty, and ultimately received dishonorable discharge.  I don't regret my decision to take NJP, my regrets lie with whom I spent my free time with.

I feel like my enlistment was robbed from me, and wish I kept my affiliation with more upstanding marines.  I would like to reenlist in the USMC to finish out my career and continue to serve my country, like I had started.  I have spoken with my nearby recruiter, but all he could tell me is that I have to get my reenlistment code changed, by speaking or writing to my local congressman.

Can you please give me more specific instructions on how I may be able to change my reenlistment code along with my "character of discharge"?

During my enlistment there were no other blemishes on my service record, in fact, I was considered to be an exemplary marine, finishing top of my class in Fort Sill, receiving Meritorious Mast and Promotion.  Given these circumstances, is there any possibility that I may return to duty?

 You'll have to apply through HQMC to have your RE-code upgraded.  To do that it would be helpful if you had your SRB as well as other good things you did included in the packet.  IF HQMC agrees, then you can re-enlist, but only after the Discharge is upgraded as well.  

 Basically, this will be a long and difficult path to go down.  OTH's are very difficult to get upgraded for the most part.  Since yours involves drug use, the chances are not very good.  

 Talking to the congressman is a start, make sure when  you go to his office you have a complete packet prepared.  Talk to his staffers ahead of time and make an appointment, don't just walk in.

 It would also be helpful to bring with you letters from prominent folks in your community, stating your good character at this time.  People like the Chief of Police or someone of that stature, clergy, and other elected officials.

 Even with all of that, it will be an uphill battle, but you should still give it a try.
