Question
Before i go back to the recruiter i would like to know your opinion. previously i had a couple convictions that were eventually dismissed because of getting a pre trial diversion. and yes ive been told that u cant join with that because the army still considers it a conviction.my question is i have also recieved a expungement of the charges after they were dismissed, and yes, i know the military can still see things on the record. my question to you is because of the expungement, would i be eligible to receive a waiver for the expungement? also my lawyer tells me that i could probably get the charges reduced to a misdemeanor  before the expungement is final. would i be eligible without a waiver if the 2 charges are reduced to misdemeanors and then expunged? then on my record i would have 2 dismissed misdemeanors instead of felonies. thank u in advance

Answer
The original charges and diversion/convictions will always count despit what the courts do.  Expungement means nothing to the military, so basically, nothing you can do will remove the fact that you did the crime, and thats all they care about.

sorry

Expertise

I am a National Guard recruiter , been doing it for seven years and am a subject matter expert on qualifications for National Guard and I keep up to date on Regular Army regs and programs. I was in the Navy for 4 years and have 13 years in the Guard. I will not sugar coat my answers to you. They are usually short and to the point. If you need more in depth, ask me. Because each situation is different, alot of times you need to actually talk to a recruiter and let them evaluate your situation in person, by looking at your documents, issues etc. If I suggest this, it would be in your best interest to do so. Finally...thank you for your interest in serving this great nation of ours. Very few people can actually make the cut to serve let alone choose to do so. So thank you for wanting to and hopefully you will get a chance. Whatever branch you choose, thank you and good luck.
