I have a tape test coming up, and I do not think I am going to do well. I just came off the overweight program about 4 months ago. If I never recived nutritional counseling the first time I went on the program. Does that make it invalid, and can I use that to fight separation if my unit decides to do so since it will be my second time in a year?

AR 600-8 is the weight control program regulation and details the steps that need to be taken for both entry to and removal from the weight control program. It also details the circumstances under which you can be chaptered for failure in this area. You should consult this regulation in determining if you were properly entered into the weight control program. If not, you have a course of action to protest your chapter.
