Question
Hellp,

First off I would like to thank you for taking the time to answer this question. I received a DUI, while in the DEP for the Army slated to do BCT and then OCS right after. My recruiter knows about the situation and said I would have to receive a DEP discharge. However, my lawyer worked out a deal to where I serve a deferred sentence and the charges will be dropped. I still want to join the army ASAP and be an officer. Can you shed any more light on my situation? Thanks, TK

Answer
Hi TK,

A deferred sentence is still what the military calls an "adverse adjudication." A DUI is a disqualifying factor for enlistment and requires a moral waiver. Right now, the Army is not granting any moral waivers for any enlistment program.

The chances of getting a moral waiver for a DUI for any officer program (at any time) are very slim.

I'm sorry. I wish I had better news for you.
