Question
I am being adsep from the navy 1 day prior to my 6 year point.  They did not officially notify me with form 1910 402.  Is this a requirement?  If so, what is the next course of action?  Will they have to re-do my paperwork and discharge me 15 days after this notice is signed by both parties?

thanks!!

Answer
Dear Shawna --

Please see your Judge Advocate General (JAG) immediately.  If the Navy did not follow their due process, they cannot separate you.  Do not sign any separation paperwork, until you have spoken to military legal counsel (JAG) -- which is your right as a service member.

Depending on your rank and your time in service, you could be authorized a discharge hearing, prior to separation.  Ask your JAG counsel about these options.

Please write back, if you have additional questions.

Good luck to you.
