Question
I served an active duty enlistment with the Marine Corps and am now drilling with a reserve unit as a non-ob. Several months ago I go into a fight with my father and ended up with a "domestic violence" misdemeanor charge. My unit, after hearing the ridiculous details of the arrest, took no disciplinary action against me and even kept me on our deployment to Afghanistan. I had been interested in going active duty Army long before this incident but I understand that this charge may prevent that. Are army recruiters required to conduct a background check on members of another branch (currently still associated with another reserve unit) that want to make an inter-branch transfer?

Answer
it may not be an issue, the general rule is you can beat up, but not down, meaning, the lautenberg amendamnet may not apply.  If you can stay in, you should be ok, as anyone with a lautenburg charge is discharged.  If you have already deployed since thenm you should be good to go for any other branch.

But, the USMC may just have missed the seriousness of it and not pursued it as well.  I would double check with the USMC for a status first.

I am a National Guard recruiter , been doing it for seven years and am a subject matter expert on qualifications for National Guard and I keep up to date on Regular Army regs and programs. I was in the Navy for 4 years and have 13 years in the Guard. I will not sugar coat my answers to you. They are usually short and to the point. If you need more in depth, ask me.
