Question: i work for a private security company and a applicant who is currently in the Army reserve was given a drug test.  If this individual shows up positive am i legally bound in notifying the Army of the results?

Answer
No. Also, even should you do so, if the test was not conducted in accordance with the Army standard for random drug testing, it would likely be inadmissible as evidence.  Lastly, if the Soldier is in the reserves he only falls under Army regulation and codes of conduct when on active duty.
